O.N.B Pressure Washing operates on onbpressurewashing.com, a website that allows customers in the Athens, Georgia area to learn about our exterior cleaning services and submit booking requests. We offer residential and commercial pressure washing, soft washing, and related exterior cleaning services.

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

Our Services are intended for users located in the United States.

Industry-specific compliance. We take reasonable measures to comply with applicable environmental laws and regulations governing our services, including the Clean Water Act (CWA) as it relates to the disposal of chemicals and wash-water runoff into storm drains. You agree to cooperate with any reasonable measures we take to remain compliant with such laws during the provision of our services.

3. Intellectual Property Rights

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks").

By using the Services, you represent and warrant that: (1) all information you submit through the Services, including in any booking request, will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update it as necessary; (3) you have the legal capacity and you agree to comply with these Legal Terms; (4) you are not under the age of 18; (5) you will not access the Services through automated or non-human means, whether through a bot, script, or otherwise; (6) you will not use the Services for any illegal or unauthorized purpose; and (7) your use of the Services will not violate any applicable law or regulation.

5. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance of the Services.

11. Governing Law

These Legal Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles. Any disputes arising under these Legal Terms shall be subject to the exclusive jurisdiction of the courts located in Madison County, Georgia, or resolved through arbitration as outlined below.

12. Dispute Resolution

Informal Negotiations

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms (each a "Dispute"), you and we agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one party to the other.

Binding Arbitration

If you and we are unable to resolve a Dispute through informal negotiations, the Dispute will be finally and exclusively resolved by binding arbitration. The arbitration shall be commenced and conducted in the United States, in Madison County, Georgia. Each party will be responsible for its own share of any arbitration fees, and each party shall bear its own costs and expenses associated with the arbitration.

Litigation Venue

If for any reason a Dispute proceeds in court rather than arbitration, such Dispute shall be brought exclusively in the state or federal courts located in Madison County, Georgia, and you and we consent to the personal jurisdiction of those courts.

Time Limitation

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the Services or these Legal Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

13. Corrections

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.

14. Disclaimer

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT OR THE CONTENT OF ANY WEBSITES OR MOBILE APPLICATIONS LINKED TO THE SERVICES.

15. Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US FOR THE SERVICES.

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your use of the Services; (2) your breach of these Legal Terms; (3) any breach of your representations and warranties set forth in these Legal Terms; or (4) your violation of the rights of a third party, including but not limited to intellectual property rights.

17. Electronic Communications, Transactions, and Signatures

You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Services, satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA THE SERVICES.

19. Additional Service Terms

The following additional terms apply specifically to the exterior cleaning services provided by O.N.B Washing LLC.

19.1 Service Conditions and Property Damage

You agree that the property to be serviced is in suitable condition to receive pressure washing or exterior cleaning services. O.N.B Washing LLC is not responsible for damage to surfaces, materials, or structures that are pre-existing, deteriorated, improperly installed, or unable to withstand standard pressure washing techniques. It is your responsibility to inform us of any known fragile, damaged, or sensitive areas prior to service. Any damage claims must be reported in writing within 48 hours of service completion.

19.2 Booking and Cancellation Policy

Booking requests submitted through this website are not confirmed until you receive a confirmation email from O.N.B Washing LLC. If you need to cancel or reschedule, reply directly to your confirmation email. Please notify us as soon as possible so we can accommodate other customers. O.N.B Washing LLC reserves the right to cancel or reschedule any appointment at any time due to weather, equipment issues, or safety concerns, with no penalty to either party.

19.3 Pricing and Payment Terms

Payment is due on site either at the beginning or end of the service unless otherwise agreed in writing with O.N.B Washing LLC before the service date. Accepted payment methods will be communicated at the time of booking. All prices provided through this website or prior to an on-site assessment are estimates only and do not constitute a binding quote. Final pricing is determined at the time of service and may differ from the estimate if actual service conditions vary from what was originally described.

19.4 Access to Property

You agree to provide safe and unobstructed access to the areas of your property to be serviced on the scheduled service date. This includes unlocking gates, moving vehicles, securing pets indoors, and providing access to an outdoor water supply (standard garden hose connection) at no charge to O.N.B Washing LLC. Water consumption during service is considered part of the normal service process. If our team cannot access the property at the scheduled time, this will be treated as a cancellation per our Cancellation Policy.

19.5 Hazardous Materials

You agree to disclose any known presence of hazardous materials, chemicals, or environmental conditions on your property prior to service. O.N.B Washing LLC is not responsible for damage or liability arising from undisclosed hazardous conditions. We reserve the right to immediately discontinue service if hazardous conditions are discovered on-site.

19.6 Right to Refuse Service

O.N.B Washing LLC reserves the right to refuse, cancel, or discontinue services at any time if conditions at the property pose a safety risk to our team, if the property is found to be in a condition that could result in damage during service, or if a customer engages in abusive, threatening, or inappropriate behavior toward our staff.

19.7 Photography and Marketing

O.N.B Washing LLC may photograph or record before-and-after images of work performed on your property for use in marketing materials, social media, and our website. No personally identifiable information (such as your name or address) will be associated with these images without your explicit consent. If you do not wish for your property to be photographed, please notify us in writing prior to your service date.

19.8 Satisfaction and Completion

If you are unsatisfied with any aspect of the service provided, you must notify O.N.B Washing LLC in writing within 48 hours of service completion. We will make reasonable efforts to address legitimate concerns, which may include returning to re-service the affected area at no additional charge. Complaints submitted after 48 hours of service completion may not be eligible for remedy.

20. Miscellaneous

These Legal Terms and any policies or operating rules posted by us on the Services or in respect to the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision. If any provision or part of a provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Legal Terms and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Legal Terms or use of the Services.
